                   AN ORDINANCE CLOSING AND ABANDONING CUSHMAN
                   STREET LOCATED NORTHWEST FROM WOOD AVENUE,
                   SOUTHWEST OF STUART STREET, MORE PARTICULARLY
                   DESCRIBED HEREIN.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned Cushman Street located northwest from Wood 
Avenue,
         Southwest of Stuart Street, more particularly described herein, 

         and as shown on plat attached hereto and made a part hereof by
         reference:
                Cushman Street, formerly 1st Avenue or Trinity
                Avenue, a right-of-way some 35 feet wide beginning
                on the northwest line of Wood Avenue 200 feet
                northeast of the intersection of the northwest line
                of Wood Avenue with the northeast line of Ford
                Street (now called Cushman Street), and extending
                northwest some 340 feet between parallel lines, and
                parallel to Ford Street.  Said street separates
                part of lot 1, block 67, Second Revised Plan of Lot
                1, Block 67 and Lot 1, Block 87, East Chattanooga
                Middle Section, as shown by plat of record in plat
                book 46, page 141, R.O.H.C., from lots 1-8 and part
                of 9, Ford and Reed's Subdivision of Block 6,
                Anderson's Addition to East Chattanooga, as shown
                by plat of record in plat book 6, page 5, R.O.H.C. 
                Tax Map No. 127M-A-11 and 127M-D-1 and 2.
               
              	   SECTION 2. BE IT FURTHER ORDAINED, That this closure 
and
         abandonment is made subject to the following conditions:

              	   1.	Reservation of an easement the width of the
                        right-of-way for South Central Bell for the 
purpose
                        of operating and maintaining its facilities in 
said
                        right-of-way.
              	   2.	The areas reserved for utility easements must be
                        kept free and clear of all structures.
              	   3.	All existing easements are retained.
        
              	   SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance 

         shall take effect two weeks from and after its passage as 
provided
         by law.
